As in most other states, a mathematical formula is used in New York State to calculate basic child support. The formula takes into account the non-custodial parent's gross income, less FICA, and applies the following percentages:

• 17% for 1 child
• 25% for 2 children
• 29% for 3 children
• 31% for 4 or more

The courts can also impute the income of a non-custodial parent by assessing a range of assets including real estate.

In addition to receiving basic child support, a custodial parent may be entitled to have the non-custodial parent pay a share of extenuating expenses for the children, such as medical insurance or daycare.
